Terms & Conditions
These Terms and Conditions (the “Terms”) govern the use of the website calmauria.com and the Calmauria service (the “Service”), provided by CR OÜ (società di diritto estone, codice registro 16778262), che opera con il marchio Calmauria (“Calmauria”, “we”, “us”). By using the Service you accept these Terms in full. If you do not accept them, do not use the Service.
Important notice. Calmauria is an AI-based emotional support and wellness service. It is not a medical or psychological service: it does not provide diagnoses, therapy or treatment and does not replace the advice of a professional. It is not an emergency service: if you or others are in danger, immediately call 112 (EU), 999 (UK) or 911 (US), or the helplines shown in the Service.
1. Nature of the Service
The Service enables real-time voice conversations (in the future also by telephone) with an artificial-intelligence assistant (“Auria”), for emotional support and wellness purposes. Responses are generated automatically and may contain inaccuracies. Auria is not a real person and is not a healthcare professional.
2. Eligibility
The Service is reserved exclusively for persons who are at least 18 years old and capable of entering into a binding contract. By registering, you represent that you meet these requirements. We reserve the right to suspend accounts where there are indications that the holder is a minor.
3. Account
Access to certain features requires creating an account with an email address and password. You are responsible for keeping your credentials confidential and for all activity carried out through your account. Notify us promptly of any unauthorised use.
4. Prices, sessions and subscriptions
- Single sessions (à la carte): each session has the duration and price shown at the time of purchase.
- Subscriptions: entitle you to a number of monthly sessions/minutes, subject to any daily limits stated in the plan. Unused minutes do not roll over from one billing cycle to the next.
- Prices are shown in the currency of your market (EUR, GBP or USD) and include applicable taxes unless stated otherwise.
- We may change prices for the future; changes do not affect billing cycles already paid for.
5. Payments, renewals and cancellation
Payments are processed through Stripe. Subscriptions renew automatically at the end of each billing cycle unless cancelled. You may cancel your subscription at any time from your account area: cancellation takes effect at the end of the current billing cycle and does not entitle you to a refund of the portion already paid, except as required by law.
6. Right of withdrawal and refunds
For digital content and services, by requesting that a session start immediately before the withdrawal period expires and acknowledging that you thereby lose your right of withdrawal, you consent to the immediate performance of the Service. Without prejudice to mandatory consumer rights, payments for sessions already used are non-refundable. If you experience any problems, contact us: we assess requests in good faith.
7. Acceptable use
You agree not to:
- use the Service for unlawful or harmful purposes;
- attempt to circumvent security measures, limits or payment mechanisms;
- use the Service on behalf of minors or third parties without authorisation;
- extract, resell or reproduce the Service or its content without consent.
8. Crisis situations
The Service is not suitable for handling emergencies or acute crises. Where risk signals are detected, Auria ends the conversation and directs you to immediate human help. It remains your responsibility to contact emergency services when needed.
9. Intellectual property
The Service, the Calmauria trademark, the content, software and graphics are protected and remain the property of us or our respective licensors. You are granted a personal, limited, non-exclusive and non-transferable licence to use the Service.
10. Limitation of liability
To the maximum extent permitted by law, the Service is provided “as is”. We do not warrant that it will be error-free or always available. We are not liable for decisions made on the basis of conversations with Auria, nor for indirect or consequential damages. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including mandatory consumer rights.
11. Suspension and termination
We may suspend or close your account in the event of a breach of these Terms, abusive use or security risks. You may close your account at any time.
12. Changes to these Terms
We may update these Terms. Changes will be published on this page; continued use of the Service constitutes acceptance of them.
13. Territorial scope and language
The Service is offered in several languages to serve users in the markets in which we operate. The Russian-language and Chinese-language versions are addressed exclusively to Russian-speaking and Chinese-speaking communities residing OUTSIDE the Russian Federation and mainland China: the Service is not directed at, promoted to, or intended for residents of those territories.
These Terms may be made available in several languages as a courtesy. In the event of any discrepancy between the versions, the Italian version prevails (for consumers in the European Union, without prejudice to any mandatory rules protecting them).
14. Governing law and jurisdiction
These Terms are governed by Italian law. For consumers, the courts of the consumer's place of residence or domicile have jurisdiction, if located in Italy, without prejudice to applicable mandatory rules.
